21. Is "stepping up of pay" permissible if a junior official draws more pay than their senior due to pay fixation under MACPS?

No, absolutely no stepping up of pay in the pay band or grade pay is admissible to a senior employee on the ground that a junior is getting more pay under the MACP Scheme.

22. Can past completed cases of financial upgradation or promotions be re-opened upon the implementation of MACPS?

No, it is explicitly clarified that no past cases would be re-opened.

23. Can differences in pay scales arising from old ACP Scheme placements versus new MACPS placements within the same cadre be legally treated as an "anomaly"?

No, such differences in pay scales within the same cadre shall not be construed as an official anomaly.

24. What is the fundamental basis for counting the three financial upgradations under MACPS?

The three financial upgradations are counted strictly from the direct entry grade of the employee on completion of 10, 20, and 30 years of regular service respectively.

25. What is the minimum continuous period an employee must spend in the same grade pay to become eligible for financial upgradation under MACPS?

A person must spend a minimum of 10 continuous years in the same grade pay to be eligible for financial upgradation.
