36. Under option (b) for ACP upgradations between 01.01.2006 and 31.08.2008, from what date is the employee entitled to draw arrears?
The employee is entitled to draw arrears of pay only from the date of their option, which is the actual date of financial upgradation under ACP.

37. If a post in the promotional hierarchy was upgraded by the 6th CPC, how is the pay of an employee who received ACP in that hierarchy before 01.09.2008 fixed?
A37: Their pay in the revised pay structure will be fixed directly with reference to the newly upgraded higher grade pay granted to that post.

38. Under which statutory rule can a government servant exercise an option to fix pay from the date of promotion or date of next increment?
The employee can exercise this option under the provisions of Fundamental Rule 22(I)(a)(1).

A40: The Grade Pay of Rs. 5400 in PB-2 and Rs. 5400 in PB-3 are treated as two entirely separate grade pays for the purpose of granting upgradations under MACPS.
