Effect of Disciplinary Proceedings on NPS Benefits

• Pension Corpus, Lump Sum, and Annuity: Rule 19 of the NPS Rules 2021 states that if disciplinary proceedings are not concluded before retirement, it will not affect the accumulation of the pension corpus, lump sum payments, and annuity.

• Gratuity: Rule 5 of the NPS Rules allows for the gratuity to be withheld (fully or partially) if an employee is found guilty of grave misconduct. Recovery of losses may also be ordered.

• Post-Retirement Proceedings: Departmental proceedings can continue after retirement, as per Rule 5.

• Gratuity Payment: Gratuity payments will be withheld until the conclusion of departmental or judicial proceedings.

• ஓய்வூதிய கார்பஸ், மொத்த தொகை மற்றும் வருடாந்திரம்: NPS விதிகள் 2021 இன் விதி 19, ஓய்வுக்கு முன் ஒழுக்காற்று நடவடிக்கைகள் முடிக்கப்படாவிட்டால், ஓய்வூதிய கார்பஸ், மொத்த தொகை மற்றும் வருடாந்திரம் திரட்டப்படுவதை பாதிக்காது என்று கூறுகிறது.

• பணிக்கொடை: NPS விதிகளின் விதி 5, ஒரு ஊழியர் சேவையில் கடுமையான தவறான நடத்தைக்கு குற்றவாளி என நிரூபிக்கப்பட்டால், அவரது பணிக்கொடை முழுமையாகவோ அல்லது பகுதியாகவோ நிறுத்தி வைக்கப்படலாம் என்றும் இழப்பீடுகள் வசூலிக்கப்படலாம் என்றும் கூறுகிறது.

• ஓய்வுக்குப் பின் நடவடிக்கைகள்: விதி 5 இன் படி, ஓய்வுக்குப் பின் துறை ரீதியான நடவடிக்கைகள் தொடரலாம்.

• பணிக்கொடை செலுத்துதல்: துறை ரீதியான அல்லது நீதித்துறை நடவடிக்கைகள் முடியும் வரை பணிக்கொடை செலுத்தப்படாது.
