Request for Amendments in the Terms of Reference (ToR) of the 8th CPC
1. Omission of Employees' Expectations in the ToR
• The Staff Side urges that Clause 2.5 of the 8th CPC ToR be recast to reinstate the phrase "with due regard to the expectations of stakeholders".
• The exclusion of this crucial phrase, which was present in the 7th CPC's ToR, sends a discouraging signal to Central Government employees.
2. Inclusion of Pension Revision for Existing Pensioners and Family Pensioners
• A clause similar to the one in the 7th CPC ToR must be incorporated to ensure the revision of pension for pre-2026 retirees is considered by the 8th CPC.
• Despite the Minister's statement that the 8th CPC was approved for over one crore employees and pensioners, the 69 lakh Central Government Pensioners and Family Pensioners have been left outside its purview. Pension is an earned right and a deferred wage, as affirmed by the Supreme Court.
• Additional Pension-Related Requests:
o Restoration of the commuted value of pension after 11 years (instead of 15 years).
o Grant of enhanced pension by 5% every 5 years after retirement, as recommended by the Parliamentary Standing Committee.
o Extension of pension revision to all pensioners/family pensioners drawing benefits under the CCS (Pension) Rules.
3. Restoration of the Old Pension Scheme (OPS)
• The matter regarding the restoration of the Old Pension Scheme (OPS) for employees recruited on or after 01.01.2004 should be brought within the ambit of the 8th CPC's ToR for a fair and holistic review.
• Over 26 lakh Central Government employees under the National Pension System (NPS) are demanding the restoration of the non-contributory, assured OPS for post-retirement security and social dignity.
4. Deletion of the Phrase "Unfunded Cost of Non-Contributory Pension Schemes"
• The phrase "unfunded cost of non-contributory pension schemes" in Para (e)(ii) of the ToR should be deleted and replaced with a phrase regarding the "likely impact on the finances... and the pensionary liabilities/benefits and the revision of pension relating to existing pensioners and family pensioners...".
• The existing terminology is inaccurate and unjust, as pension is a deferred wage and a constitutional right (Article 300A), not a fiscal burden or bounty. This terminology has not been used for pensions of Judges, Members of Parliament, or other Constitutional functionaries.
5. Explicitly Incorporate the Date of Effect of the Recommendations
• The date of effect of the 8th CPC recommendations should be explicitly incorporated in the ToR as 01.01.2026.
• Wage and pension revisions have consistently been effected once every ten years, with the 7th CPC effective from 01.01.2016. The omission of a similar clause in the 8th CPC ToR leads to employee apprehensions about the date of implementation.
6. Grant of Interim Relief
• The Government should consider granting an Interim Relief of at least 20% of the existing Basic Pay and Basic Pension to all Central Government employees and pensioners, pending the final recommendations of the 8th CPC.
• This is necessary in view of the prevailing skyrocketing cost of living and erosion of real wages and pensions.
• The letter was dated November 17, 2025.
• The Secretary (Staff Side) also requested that all constituent organizations submit their views and inputs for the Staff Side memorandum to the 8th CPC on topics like minimum wage, fitment factor, pay structure, allowances, pension issues, and more, on or before 15/12/2025
