Grievance Redressal for Government Servants

• This document outlines the process for government servants to address their grievances:

• Initial Response: If no reply is received within one month of filing a grievance, the individual can request an interview with the next higher authority. That officer should take immediate action.

• Timely Resolution: Representations against superiors' orders should be dealt with expeditiously, preferably within one month. This time limit doesn't apply to repeated representations on the same issue.

• Interim Reply: If a grievance cannot be resolved within one month, an acknowledgment or interim reply should be sent to the individual. (OM No. 25/34/68- Estt (A) dated 20.12.1968)

• Proper Channel: Submitting representations by bypassing the proper channel of communication (including emails and public grievance portals) is considered unbecoming of a government servant. (OM No 11013/08/2013-Estt A III dated 6.6.2013 & 31.8.2015)

• Advance Copies: Advance copies of representations that don't demonstrate attempts to seek redress from lower authorities should be ignored. If such attempts are evident, the representation can be examined and referred to the lower authority for comments. Orders should not normally be passed without these comments. (OM 118/52-Ests dated 30.4.1952)

• Representations by Relatives: Representations submitted by relatives on service matters are generally not considered, except in cases of the employee's death or physical disability preventing them from representing themselves. (OM No.25/21/63-Ests(A) dated 19.9.1963)

• Disciplinary Action: Violating these instructions may lead to disciplinary action. (OM No 11013/7/1999-Estt A dated 1.11.1999 & 11013/08/2013-Estt A III dated 6.6.2013)

• Legal Recourse: Government servants can seek redress through legal channels without prior permission. (OM No.25/3/59-Ests (A) dated 21.4.1959 & 25/29/63-Ests(A) dated 26.11.1963)

அரசு ஊழியர்களின் குறைகளை நிவர்த்தி செய்தல்

• அரசு ஊழியர்கள் தங்கள் குறைகளை நிவர்த்தி செய்வதற்கான செயல்முறையை இந்த ஆவணம் விளக்குகிறது:

• ஆரம்ப பதில்: குறைபாடு மனு தாக்கல் செய்து ஒரு மாதத்திற்குள் பதில் கிடைக்கவில்லை என்றால், தனிநபர் அடுத்த உயர் அதிகாரியுடன் நேர்காணலுக்குக் கோரலாம். அந்த அதிகாரி உடனடியாக நடவடிக்கை எடுக்க வேண்டும்.

• சரியான நேரத்தில் தீர்வு: உயர் அதிகாரிகளின் உத்தரவுகளுக்கு எதிரான பிரதிநிதித்துவங்கள் விரைவாகவும், முன்னுரிமையாக ஒரு மாதத்திற்குள்ளும் கையாளப்பட வேண்டும். ஒரே விஷயத்தில் முந்தைய பிரதிநிதித்துவத்தை முடித்த பிறகு மீண்டும் பிரதிநிதித்துவம் செய்தால் இந்த கால வரம்பு பொருந்தாது.

• இடைக்கால பதில்: ஒரு மாதத்திற்குள் குறைபாடு தீர்க்க முடியாவிட்டால், தனிநபருக்கு ஒப்புதல் அல்லது இடைக்கால பதில் அனுப்பப்பட வேண்டும். (OM எண். 25/34/68- Estt (A) தேதி 20.12.1968)

• சரியான வழி: சரியான தகவல் தொடர்பு வழியை மீறி பிரதிநிதித்துவங்களை சமர்ப்பிப்பது (மின்னஞ்சல்கள் மற்றும் பொது குறைபாடுகள் போர்டல் உட்பட) அரசு ஊழியருக்குத் தகுதியற்றதாகக் கருதப்படுகிறது. (OM எண். 11013/08/2013-Estt A III தேதி 6.6.2013 & 31.8.2015)

• முன் நகல்கள்: கீழ் அதிகாரிகளிடமிருந்து நிவாரணம் பெற முயற்சிகள் மேற்கொள்ளப்பட்டதையும், தீர்ந்துவிட்டதையும் நிரூபிக்காத பிரதிநிதித்துவங்களின் முன் நகல்கள் புறக்கணிக்கப்பட வேண்டும். அத்தகைய முயற்சிகள் தெளிவாகத் தெரிந்தால், பிரதிநிதித்துவம் பரிசீலிக்கப்பட்டு கருத்துகளுக்காக கீழ் அதிகாரிக்கு அனுப்பப்படலாம். பொருத்தமான அதிகாரத்தின் கருத்துகளை அறியாமல் பொதுவாக உத்தரவுகள் பிறப்பிக்கப்படக்கூடாது. • உறவினர்களால் பிரதிநிதித்துவங்கள்: சேவை விஷயத்தில் உறவினர்களால் சமர்ப்பிக்கப்படும் பிரதிநிதித்துவங்கள் பொதுவாகக் கருத்தில் கொள்ளப்படாது, ஊழியரின் மரணம் அல்லது உடல் ஊனம் காரணமாக தங்களை பிரதிநிதித்துவப்படுத்த முடியாவிட்டால் மட்டுமே விதிவிலக்கு. (OM எண்.25/21/63-Ests(A) தேதி 19.9.1963)

• கட்டுப்பாட்டு நடவடிக்கை: இந்த அறிவுறுத்தல்களை மீறுபவர்களுக்கு எதிராக ஒழுக்காற்று நடவடிக்கை எடுக்கப்படலாம். (OM எண். 11013/7/1999-Estt A தேதி 1.11.1999 & 11013/08/2013-Estt A III தேதி 6.6.2013)

• சட்டப்பூர்வ நிவாரணம்: அரசு ஊழியர்கள் முன் அனுமதி இல்லாமல் சட்டப்பூர்வ வழிகள் மூலம் நிவாரணம் பெறலாம். (OM எண்.25/3/59-Ests (A) தேதி 21.4.1959 & 25/29/63-Ests(A) தேதி 26.11.1963)
