 33. KNOWLEDGE SPECTRUM - DISCIPLINE -

31. There is no provision for withholding of appeal by the DA. The appeal should be forwarded to the Appellate authority within 45 days from the date of receipt of the appeal. Petitions, memorials, etc, should be forwarded to the proper authorities within 60 days. 

32. The appellate work can be redistributed among officers of equivalent rank, if a large number of appeals are pending. The Appellate authority has to send a detailed statement of appeals pending disposal for over a month to the next higher authority for review. If the Appellate authority is the President, the statement should be sent to the Secretary of the Department.

33. The Appellate authority should issue a self-contained, speaking and reasoned order. All the points raised by the appellant should be summarized in the order and be logically discussed.

மேல்முறையீட்டை DAவால் நிறுத்தி வைப்பதற்கான எந்தவொரு விதியும் இல்லை. மேல்முறையீடு பெறப்பட்ட தேதியிலிருந்து 45 நாட்களுக்குள் மேல்முறையீட்டு அதிகாரத்திற்கு அனுப்பப்பட வேண்டும். மனுக்கள், நினைவுக் குறிப்புகள் போன்றவை 60 நாட்களுக்குள் உரிய அதிகாரிகளுக்கு அனுப்பப்பட வேண்டும்.

அதிக எண்ணிக்கையிலான மேல்முறையீடுகள் நிலுவையில் இருந்தால், சமமான தரவரிசையில் உள்ள அதிகாரிகளுக்கு இடையே மேல்முறையீட்டுப் பணி மறுபகிர்வு செய்யப்படலாம். மேல்முறையீட்டு அதிகாரம் ஒரு மாதத்திற்கு மேல் நிலுவையில் உள்ள மேல்முறையீடுகளின் விரிவான அறிக்கையை ஆய்வுக்காக அடுத்த உயர் அதிகாரத்திற்கு அனுப்ப வேண்டும். மேல்முறையீட்டு அதிகாரம் குடியரசுத் தலைவராக இருந்தால், அறிக்கை துறையின் செயலாளருக்கு அனுப்பப்பட வேண்டும்.

மேல்முறையீட்டு அதிகாரம் சுயாதீனமான, விளக்கமான மற்றும் காரணங்களுடன் கூடிய உத்தரவைப் பிறப்பிக்க வேண்டும். மேல்முறையீட்டாளரால் எழுப்பப்பட்ட அனைத்து புள்ளிகளும் உத்தரவில் சுருக்கமாகக் கூறப்பட்டு தர்க்கரீதியாக விவாதிக்கப்பட வேண்டும்.
