Representation against non grant of MACP to promotee after completion of 20 years

 MACP II after completion of 20 years of service from the basic cadre had been denied to a promote officials who passed the PA Exam after completion of 14 years in the Postman cadre. He had been told that he will get his MACP II after completion of 10 years service in the PA cadre.

A representation was prepared by Com D.Vetrivel, Divisional President, Vriddhachalam division with my guidance. The same is reproduced hereunder.

Having profound regards, full faith in your sense of justice, I earnestly submit the following representation for your kind consideration and favourable orders please. 

 2) I joined the central govt service in the capacity of Postman at …………. SO, ……….. Division on 05.11.1998. Consequently, on completion 10 years of service I had been granted MACP-I on 20.11.2008. I had successfully passed the LDCE examination and promoted as Postal Assistant with effect from 20.06.2012 and been granted one increment. It is to state that even after completing 10 years of service from MACP-I in the level-4 (erstwhile grade pay of Rs.2400 in VI CPC) and completing 20 years from DCCS, I had been denied MACP-II (to the level-5) by SPOs, ………… division vide letter cited under reference-3 stating that promotion to PA to be treated as MACP-II. The contention of SPOs, ………. Division that the next MACP will be granted only after completing 10 years of service in PA cadre is against the rules on the subject.

 3) The para 4 of MACP rules 2009 envisages that due to the fixation earned earlier at the time of MACP-I, fixation of promotional pay could not be done. So, it is given to understand that the promotion earned has nothing to do with prospective MACP II. The statutory entitlements of this kind are very well depicted in illustration under para 27(B) of DOPT OM no.35034/3/2015-Estt(D) dated 22.10.2019.

4) Had I remained in postman cadre, I would have been granted MACP-II (to the level 5 of VII pay matrix) now. My friends in the postman cadre having same service of mine, were now elevated to level-5.

  5) The very objective of MACP scheme is to alleviate stagnation as regards an employee who has a number of regular years of service on the same post without any avenue of promotion. If I have not granted MACP-II (to the level 5) after completion of 10 years of service in level 4 and 20 years of service from DCCS, the objective of MACP does not serve its purpose.

 In view of above submissions, I humbly request the benign Postmaster’s General kind intervention in this matter and cause order to grant MACP-II benefit from November 2018 for which act of kind consideration, I shall ever be grateful.
