Transfer Guidelines dated 31.12.2021
Procedure / timeline for Rule-38 transfers laid vide transfer guidelines dated 17.01.2019 have been reviewed and revised by the DoP vide Letter No.X-12/6/2021-SPN-II(2) dated 31.12.2021. Few Key aspects are as follows:
- Transfer window system has been dispensed with.
- Transfer requests will be processed month-wise
- Date & time of receipt of transfer request to determine seniority. If there is a tie, date of joining in present cadre will be taken into account. If tie still exists, date of birth will be considered.
- However, transfer requests of Persons with disabilities, officials appointed on compassionate grounds, officials/ dependents suffering from terminal illness , will be placed on top of all requests.
- Maximum of 10 choices can be considered. If he/she could not be accommodated in requested division, transfer to anyone of the divisions will be considered.
- Accommodation in requested division will be based on vacancy only
- Transfer requests of officials with disciplinary / vigilance case pendency will also be considered. However, they will be relieved on conclusion of proceedings only.

Do and Don't for Investors while Investing through Agent
- An account for any of the National Small Savings Schemes can be opened and money can be deposited by himself/herself by visiting the Post Office/Bank Branch in person.
- Facility of making online deposit is also available for certain schemes in Banks such as E-Kisan Vikas Patra, Public Provident Fund and Sukanya Samridhi Account.
- In case one decides to avail the services of Authorised Agents, the following is the advice:
- Establish identity of Authorised Agents by checking his Certificate of Authority and date of validity of the agency
- Fill in the application form yourself. However, help/guidance of the agent may be availed
- Always insist for Authorised Receipt duly completed by the agent while handing over money/instruments and documents to the agent for opening an account or making deposit. These receipt books are supplied by Government to the agents (Authorised Agents Receipt Books and ASLAAS – 5 cards for MPBKY agents)
- Preserve counterfoils of the ASLAAS 5 cards till maturity of the account
- If an agent declines or avoids issue of receipt book/ASLAAS card, do not entertain him/her and report the matter to the Postal/District Authorities.
- Ensure receipt of passbook from the agent within 10 days from the date of investment. In case of non-receipt of passbook from the agent within 10 days from the date of Investment, lodge a complaint with either Appointing Authority; Regional Director, National Savings Institute; Concerned Post Master.
- Invariably verify the correctness of the amount, date, stamp, signature etc. mentioned in the Passbook from the concerned Post Office from time to time
- Do not hand over the cash to any unauthorised person or issue a cheque in favour of an agent
- For investment over and above ₹10,000; issue only an account payee cheque drawn in favour of concerned Post Master
- Do not fill/sign the withdrawal form before maturity

Whether Joint Representation from Govt. Servants is allowed under the Conduct
rules?
No. Joint representations by Govt. servants
should be viewed as subversive of discipline and such representations should
not, therefore, be entertained. Every Govt. servant making a representation
should do so separately and his own name.

60. What is She-Box?
(i) SHe-Box is an
online Complaint Management System for lodging complaints related to sexual
harassment of women at workplace. The steps required for filing of complaint
through SHe-Box can be downloaded from the link:

Any woman working or visiting any office of Central Government (Central
Ministries, Departments, Public Sector Undertakings, Autonomous Bodies and
Institutions etc.) can file complaint related to sexual harassment at workplace
through this SHe-Box .
(iii)
Once a complaint is submitted to the SHe-Box, it will directly send the
complaint to the Internal Complaints Committee (ICC) of the concerned Ministry
/Department /PSU /Autonomous Body etc; having jurisdiction to inquire into the
complaint. The Internal Complaints Committee will take action as prescribed
under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and
Redressal) Act, 2013 and update the status of the complaint through
'Administrator Login'
(iv)
The status of complaint can be viewed at any time by pressing the tab 'View
Status of Your Complaint' within SHe-Box.

61. Whether
an official can hold the posts in the co op societies more than four years?
No. Maximum period allowed is four years
or two tenure whichever is earlier. While granting permission under Rule
15(1)(c) of CCS (Conduct) Rules, 1964, it may also be necessary that cases of
such sanctions are reviewed from time to time and permissions earlier granted
revoked where Government servants have been holding office in any body, whether
incorporated or not, for more than four years or in cases there are charges of
corruption, adverse audit paras etc

62.
What is the limit for intimation in respect of transactions in sale and
purchase of shares, securities, debentures etc?
An
intimation may be sent in the proforma to the prescribed authority in respect
of all Government servants, if the total transactions in shares, securities,
debentures, mutual funds scheme, etc. exceeds six months' basic pay of
Government servant during the calendar year (to be submitted by 31st January of
subsequent calendar year).

63. What is the due date of intimation
by a Government Servant to the prescribed authority about acquiring or
disposing of any immovable/movable property either in his/her own name or in
the name of any member of his/her family and submission of declarations?
Every public servant shall file declarations,
information or return, as the case may be regarding his assets and liabilities
as on the 31st day of March every year to the Competent Authority,
on or before the 31st day of July of that year.

CCS - CONDUCT RULES 1964
54. What are the
conditions to a Government servant for acquiring and disposing of immovable
property outside India?
Without the previous sanction of the
prescribed authority, a Government servant should not (a) acquire, by purchase,
mortgage, lease, gift or otherwise either in his own name or in the name of any
member of his family, any immovable property situated outside India. (b)
Dispose of, by sale, mortgage, gift, or otherwise or grant any lease in respect
of any immovable property situated outside India which was acquired or is held
by him either in his own name or in the name of any member of his family.
[Sub-rules (a) and (b) of Rule 18-A]
55. State the
provisions in the Central Civil Services (Conduct) Rules, which relate to
bigamous marriage?
As per rule 21 of CCS (Conduct) Rules
1964, a Government servant having a spouse living should not enter into, or
contract, a marriage with any person without first obtaining the permission of
the Government even though such marriage is permissible under the personal law
applicable to such Government servant.
Similarly, a Govt servant should not
enter into, or contract a marriage with a person having a spouse without first
obtaining the permission of the Government even though such marriage is
permissible under the personal law applicable to such Government servant.

56. What are
provisions in the CCS(Conduct)Rules, which relates to consumption of
intoxicating drinks and drugs by Government servants?
As per rule 22 of CCS (Conduct) rules,
a Government servant should strictly abide by any law relating to intoxicating
drinks or drugs in force in any area in which he is living on duty. He should
take care that the performance of his duties is not affected in any way by the
influence of any intoxicating drink or drug and he should neither appear in a
public place in a state of intoxication nor habitually use any intoxicating
drink or drug to excess. He should refrain from consuming any intoxicating
drink or drug in a public place.

57. Can a Govt. servant bring or
attempt to bring any political or other outside influence in matter pertaining
to his service?
It is an offence under Rule 20 of Conduct Rules to bring or attempt to bring political or other outside influence, pertaining to service matter of a Govt. servant. He will be liable for proceeding departmentally for such offence.
58. What is the prohibition regarding
employment of children below 14 years of age?
No
Government servant shall employ to work any child below the age of 14 years.

CCS - CONDUCT RULES 1964
50. A Govt
servant should manage his private affairs as to avoid habitual indebtedness or
insolvency. What are the restrictions imposed on him to ensure it?
1. A Government servant should manage
his private affairs in such a manner as to avoid habitual indebtedness or
insolvency.
2. A Government servant against whom
any legal proceeding is instituted for the recovery of any debt due from him or
for adjudging him as an insolvent, should immediately report the full facts of
the legal proceedings to the Government.
3. It will be the responsibility of the
Government servant to prove that the insolvency or indebtedness was the result of
circumstances which, with the exercise of ordinary diligence, the Government
servant could not have foreseen, or over which he had no control, and had not
proceeded from extravagant or dissipated habits.
(Rule 17)
51. A Government servant wants to acquire or dispose of any movable or immovable property, What procedure is to be followed by him?
(1) Every govt servant on his first
appointment to any service or post should submit the property return in the
prescribed form without fail. A Government servant should not acquire or
dispose of any immovable property by lease, mortgage, purchase, sale, gift or
otherwise either in his own name or in the name of any member of his family
without the previous knowledge of the prescribed authority.
(2) If a Government servant enters into
a transaction in respect of movable property either in his own name or in the
name of a member of his family, he should report the same to the prescribed
authority within one month from the date of such transaction, if the value of
the property exceeds Rs. 20,000 in the case of Group ‘A’ and Group 'B' officers
or Rs. 15,000 in the case of Group 'C' and 'D' officials.
(1) In the cases of (1) and (2) above,
the previous sanction of the prescribed authority is necessary if any such transaction
is :
(a) with a person having official
dealings with the Government servant; or
(b) not through the regular or reputed
dealer.
Moveable property includes jewellery,
insurance policies, the annual premia of which exceeds Rs. 20,000 or one-sixth
of the total annual emoluments received from Government, whichever is less,
shares, securities and debentures, loans advanced by such Government servants,
motor cars, motor cycles, horses, refrigerators, radios, radiograms and
television sets.

53. What punitive
action is prescribed in CCS(Conduct) Rules for failure to submit Annual
property return in time?
In accordance with the provisions of
clause (ii) of 18(1) of the CCS(Conduct) rules, every Govt servant holding a
post of “A” or 'B' post is required to submit the annual return giving full
particulars regarding the immovable property inherited by him or owned or
acquired by him or held by him on lease or mortgage either in his own name or
in the name of any member of his family. Such reports should be submitted in
the month of January by 31st, every year. Failure on the part of a Govt servant
to comply with the requirement of the aforesaid rule can form good and
sufficient reason for instituting disciplinary action against him.

After the promulgation of Lokayudha,
the returns should be submitted in the month of July every year.
