PROCEDURE IN PRELIMINARY HEARING

831. Due and timely notice should be sent to the charged employee for securing his presence in the preliminary hearing, but in exceptional cases where he does not participate in the preliminary hearing without proper cause, the inquiry officer may proceed as if the charges have been denied and hold the preliminary hearing by following the procedure meticulously. A copy of daily order sheet made in the hearing should be sent to the charged employee.

832. But, if the charged employee is present, the preliminary hearing should not be postponed for the simple reason that his defence assistant is not present. The reason is that the business to be transacted in preliminary hearing is such which can be done without his defence assistant.

Documents used during the Inquiry
833. There are two categories of documents which are taken on record by the inquiry officer and form part of the record of inquiry. These are - - (i) the Listed documents, and (ii) the Defence documents. What exactly these documents are and to what extent the charged employee may be allowed access to them is discussed, adequately, in the paragraphs that follow.
