Entitlements on Discharge Due to Invalidation/Disablement of NPS-Entitled Employee

• This order outlines the entitlements for an NPS-covered employee discharged due to invalidation or disablement:

• CCS NPS Rules (Rules 16 & 17): These rules govern discharge due to invalidation or disablement. Section 20 of the Rights of Persons with Disabilities Act 2016 does not apply in these cases.

• Application Process: The employee (or their spouse on their behalf) may apply to the Head of Office (HOD) for retirement on invalidation. The HOD must forward the application for medical examination within 15 days, and the examination should be completed within 30 days. The employee should receive a copy of the forwarded application.

• Medical Examination: The NPS subscriber must appear before the medical authority, which will determine if they are fit or unfit for further service. No medical certificate should be issued otherwise than as referred by the Department.

• Unfit Declaration: If declared unfit, the employee may be granted retirement benefits on invalidation.

• Fit with Less Laborious Character: If declared fit but for a less laborious role, they may be posted to a lower post. If no such post is available, they may be granted retirement benefits as if retired due to invalidation.

• Option Under Rule 10 (NPS): If the employee opted for benefits under Rule 10 of the NPS Rules (i.e., benefits as per CCS Pension Rules), this should be considered. The individual pension account will be closed, the government contribution will be transferred to government accounts, and the remaining amount will be paid to the subscriber.

• NPS Option: If the employee chose the NPS option, the NPS rules regarding exits and withdrawals will apply.

• Default Option: If the default option under Rule 10 of the NPS Rules applies, the CCS Pension Rules and Extraordinary Pension Rules will be applicable.

NPS-ல் தகுதி பெற்ற ஊழியரின் செல்லுபடியாகாமை அல்லது ஊனமுற்றதால் பணிநீக்கம் செய்வதற்கான உரிமைகள்.

• இந்த உத்தரவு, NPS-ல் உள்ளடக்கப்பட்ட ஊழியர் செல்லுபடியாகாமை அல்லது ஊனமுற்றதால் பணிநீக்கம் செய்யப்பட்டால் கிடைக்கும் உரிமைகளை விளக்குகிறது:

HOD விண்ணப்பத்தை 15 நாட்களுக்குள் மருத்துவ பரிசோதனைக்கு அனுப்ப வேண்டும், மேலும் பரிசோதனை 30 நாட்களுக்குள் முடிக்கப்பட வேண்டும். அனுப்பப்பட்ட விண்ணப்பத்தின் நகல் ஊழியருக்கு வழங்கப்பட வேண்டும்.

• மருத்துவ பரிசோதனை: NPS சந்தாதாரர் மருத்துவ அதிகாரத்தின் முன் ஆஜராக வேண்டும், அவர்கள் மேலும் சேவைக்கு தகுதியுடையவரா அல்லது தகுதியற்றவரா என்பதை தீர்மானிப்பார்கள். துறையால் குறிப்பிடப்பட்டதைத் தவிர வேறு எந்த மருத்துவ சான்றிதழும் வழங்கப்படக்கூடாது.

• தகுதியற்ற அறிவிப்பு: தகுதியற்றவர் என்று அறிவிக்கப்பட்டால், ஊழியருக்கு செல்லுபடியாகாமையால் ஓய்வு பெறும் பலன்கள் வழங்கப்படலாம்.

• குறைந்த கடினமான தன்மைக்கு தகுதியானவர்: தகுதியானவர் என்று அறிவிக்கப்பட்டால், ஆனால் குறைந்த கடினமான பாத்திரத்திற்கு, அவர் குறைந்த பதவிக்கு நியமிக்கப்படலாம். அத்தகைய பதவி எதுவும் கிடைக்கவில்லை என்றால், செல்லுபடியாகாமையால் ஓய்வு பெற்றதைப் போல ஓய்வு பெறும் பலன்கள் அவருக்கு வழங்கப்படலாம்.

• விதி 10 (NPS) இன் கீழ் விருப்பம்: ஊழியர் NPS விதிகளின் விதி 10 இன் கீழ் பலன்களைப் பெற (அதாவது, CCS ஓய்வூதிய விதிகளின்படி பலன்கள்) விருப்பம் அளித்திருந்தால், இது பரிசீலிக்கப்பட வேண்டும். தனிநபர் ஓய்வூதியக் கணக்கு மூடப்படும், அரசாங்க பங்களிப்பு அரசாங்க கணக்குகளுக்கு மாற்றப்படும், மீதமுள்ள தொகை சந்தாதாரருக்கு வழங்கப்படும்.

• NPS விருப்பம்: ஊழியர் NPS விருப்பத்தைத் தேர்ந்தெடுத்திருந்தால், NPS இன் கீழ் வெளியேறுகள் மற்றும் திரும்பப் பெறுதல்கள் தொடர்பான NPS விதிகள் பொருந்தும்.

• இயல்புநிலை விருப்பம்: NPS விதிகளின் விதி 10 இன் கீழ் இயல்புநிலை விருப்பம் பொருந்தினால், CCS ஓய்வூதிய விதிகள் மற்றும் அசாதாரண ஓய்வூதிய விதிகள் பொருந்தும்.
