According to Note 4 and Note 3 of the Department of Posts (Postal Assistant and Sorting Assistant) Recruitment Rules, 2022, how is the eligibility of an official determined for promotion with respect to financial upgradations, and what specific rule governs the protection of senior officials when their juniors become eligible?
Determination of Eligibility (Note 4): The eligibility of an official for promotion must be determined strictly with respect to the post they hold substantively and the relevant pay level of that post in the Pay Matrix. It cannot be determined with respect to the higher pay level or grade an official is currently drawing pay in by virtue of financial upgradations received under Time Bound One Promotion (TBOP), Biennial Cadre Review (BCR), or Modified Assured Career Progression (MACP) as on the crucial date of eligibility.
Seniority Protection Condition (Note 3): Where junior officials who have completed their qualifying or eligibility service are being considered for promotion, their seniors will also be considered, provided that the seniors:
Are not short of the required qualifying or eligibility service by more than half of such service or two years, whichever is less.
Have successfully completed their probation period for promotion to the next higher grade along with their juniors.
This senior-junior relaxation condition does not apply to junior officials who have lost their original seniority after availing a transfer under Rule-38 of the Postal Manual Volume-IV.
