121. Whether the punishment of ‘censure’ stands in the way of promotion?
No. The penalty of censure does not by itself stand against one’s promotion. Fitness is judged on the basis of an overall assessment of his service record. (DOPT OM No. 22011/4/98-Estt (D) dated 12.04.1999)
122. Is there any time limit for forwarding appeals prescribed?
Yes. Appeals should be promptly forwarded to appellate authorities within a period of 45 days from the date of receipt. (Rule 25 of CCS (CCA) Rules, 1965)
123. If an employee was detained in police custody erroneously or acquitted without prosecution, what will be the treatment of the period of absence?
The period of absence may be treated as spent on duty for all purposes. (Rule 54-B of FR)
124. What are the punishments under Rule 6 of GDS (Conduct & Engagement) Rules?
The punishments are: Minor Penalties: Censure, Warning that his future good service depends on better performance, Recovery of pecuniary loss. Major Penalties: Removal from engagement, Dismissal from engagement. (Rule 6 of GDS (Conduct & Engagement) Rules)
125. Whether a GDS official who is undergoing training at the PTC is entitled to be paid TA/DA?
Yes. GDS staff undergoing training in departmental training centres are eligible for the grant of Daily Allowance (DA) at the same rate as the lowest paid Central Government employee. (GDS (Conduct & Engagement) Rules)
