DISCIPLINARY RULES

116. Whether any official can be reduced to a rank lower than the rank for which he was initially appointed, as a punishment? 

No. The status can be reduced to a lower rank, but it should not be the lower rank than the post for which he was appointed initially. (Rule 11 of CCS (CCA) Rules, 1965)

117. Whether the punishment order awarded with cumulative effect will affect the seniority? 

The punishment order awarded with cumulative effect will affect the increment but will not affect the seniority of the official. However, an order of reduction to a lower rank/post will affect seniority, if ordered as such. (Rule 11 of CCS (CCA) Rules, 1965)

118. Whether the officer holding current charge can award punishments? 
No. Officers holding current charge of the post or officiating in temporary vacancies cannot exercise the statutory powers of the posts in disciplinary cases. (Rule 11 of CCS (CCA) Rules, 1965)

119. Whether the closed cases can be reopened and proceeded further? 
No. Once the disciplinary authority closes a case, the same matter cannot be reopened again. However, the reviewing authority can reverse the order earlier made, within the prescribed period. (Rule 29 of CCS (CCA) Rules, 1965)

120. An official was ordered for recovery and subsequently awarded with punishment for the same lapse. Is this double punishment?
 
Two punishments should not be imposed for the same offence. However, recovery can be ordered for the pecuniary loss sustained to the Government along with any other penalty. (Rule 11 of CCS (CCA) Rules, 1965)
