National Workshop on Pension Litigation held on July 2, 2025

The Department of Pension and Pensioners' Welfare (DoPPW) issued OM regarding a National Workshop on Pension Litigation held on July 2, 2025. The workshop aimed to improve pension litigation strategy and coordination among stakeholders.

The workshop was attended by Nodal Officers, Panel Lawyers, and Legal Experts from various Ministries and Departments. The workshop pursued the Department of Legal Affairs' directive for effective and efficient management of litigation by the Government of India.

The workshop focused on strengthening pension litigation management, enhancing coordination among all stakeholders, and mitigating litigation through legal, administrative, and digital reforms.

The compendium includes case studies on various pension-related issues, such as:

Case 1: Parity in pension for pre-2006 retirees with post-2006 retirees. This case discusses the legal challenges and the government's response through the Finance Act, 2025, which validates the government's authority to classify pensioners based on their date of retirement. The document also details the dismissal of contempt petitions related to this matter.

Case 2: A contempt petition for pre-2016 and post-2016 retirees for re-fixing of pension based on the 6th Central Pay Commission recommendations.

Case 3: Pension forfeiture for absorbed PSU employees, with a detailed look into Rule 37(29)(c) and a landmark Supreme Court decision.

Other cases: The compendium also includes case studies on court cases related to Rule 10A, pension fixation for pre-2006 retirees with twenty years of qualifying service, additional pension, and government instructions on court orders.

Various officials, including Shri R. Venkataramani, the Attorney General of India, stressed the need for a national approach to litigation management and proposed a target of "zero pension litigation" by 2028 through proactive administrative measures, grievance resolution, and the use of digital tools.

The document highlights the government's commitment to pensioner welfare and the challenges of pension administration due to litigation and the growing number of pensioners. It also stresses the importance of using technology and AI-driven tools while maintaining a human-centered approach to grievances.
