252. Daily Rules Recap – No departmental proceedings after four years

The Punjab and Haryana High Court has observed that departmental proceedings cannot be initiated against a retired government employee after the statutory period of four years.

A retired employee, after this statutory period of four years, should be left in peace.

After hearing the plea, the High Court ordered the departmental proceedings to be set aside.

There is a complete embargo on the initiation of departmental proceedings regarding events that may have taken place more than four years prior to the initiation of those proceedings.

This applies if the alleged misconduct occurred more than four years prior to the date of issuance of the charge sheet.
