252. Daily Rules Recap – No departmental proceedings after four years
• The Punjab and Haryana High Court has observed that departmental proceedings cannot be initiated against a retired government employee after the statutory period of four years.
• A retired employee, after this statutory period of four years, should be left in peace.
• After hearing the plea, the High Court ordered the departmental proceedings to be set aside.
• There is a complete embargo on the initiation of departmental proceedings regarding events that may have taken place more than four years prior to the initiation of those proceedings.
• This applies if the alleged misconduct occurred more than four years prior to the date of issuance of the charge sheet.
