251. Daily Rules Recap - Entitlement on discharge due to invalidation or disablement of NPS entitled
• As per Rule 16 & 17 of the CCS (NPS) Rules, individuals entitled to discharge on invalidation or disablement, other than those covered under Section 20 of the Rights of Persons with Disabilities Act, 2016, are eligible.
• An employee may apply to the Head of Department (HOD) for retirement on invalidation. If the employee is not in a position to apply, their spouse may do so on their behalf.
• Upon receipt of such an application, the Head of Office shall, within 15 days, forward it for medical examination. This examination should be carried out within 30 days, and a copy of the report provided to the official.
• The NPS subscriber shall appear before the medical authority, which will examine them to determine if they are fit or unfit for further service.
• No medical certificate should be issued unless it is referred by the Department.
• If declared unfit for further service, the employee may be granted retirement benefits on invalidation.
• If declared fit for service but suitable for a less laborious character of duties, the employee may be posted to a lower post. If no suitable lower post is available, they may be granted benefits on retirement under invalidation.
• If the employee has exercised their option under Rule 10 of the NPS Rules for availing benefits as per CCS Pension Rules, this option should be considered.
• In such cases (where CCS Pension Rules are opted), the individual pension account should be closed. The Government's contribution will be transferred to Government accounts, and the remaining amount shall be paid to the subscriber.
• If the option for NPS benefits is exercised, the NPS rules applicable as per the Exits and Withdrawals under NPS will apply.
• If the default option under Rule 10 of the NPS Rules is applied, the CCS Pension Rules & Extraordinary Pension Rules will be applicable. (DOP & PW OM No. 57/03/2022-P & PW(B)/8361 (2) dated October 28, 2022)
