136. Whether recovery of pay is a bar to promotion?
As per Dte. letter No. 22.12.87, there is no bar to one being promoted while the recovery is in progress because such promotion will not affect the enforcement of the penalty.
137. Whether ‘Censure’ debars a Govt. Servant from appearing inthe promotional examination?
A Govt. Servant shall not be debarred from appearing in a departmental promotional examination merely because of the penalty of ‘Censure’ imposed on him.

138. Whether disciplinary action can be taken against an official for refusing promotion?
If the reasons adduced by an official for his refusal of promotion are not acceptable, the appointing authority should enforce the promotion of the official and in case if he still refuses to be promoted, then even disciplinary action can be taken against him for refusing to obey orders.

139. Whether the adverse entry in the confidential report is operative in case the representation made against the same is indisposed by the authority?
Adverse remarks should not be deemed to be operative if any representation filed within the prescribed limit is pending. Further, the representation should be decided within one month by the competent authority.
