60. Model Representation - One official was ordered for a deputation and relieved. But due to health condition he could not join but requested for grant of leave. The official was charge sheeted. This was reply given at that time

With due respect, I am writing to address the matter of my alleged unauthorized absence from the office headquarters. I must emphasize that I did not violate any departmental orders, as I was officially relieved on deputation to …………. SO on …………. forenoon; therefore, my departure from the headquarters was implicitly authorized.
Despite experiencing a fever, I continued to attend the office and was preparing to leave ………..and join the deputed station at ………. SO on …………, as directed by my supervisor. However, my health deteriorated due to a sudden change in the atmosphere, to which I was unaccustomed, and I was diagnosed with acute illness at the Government Hospital, ………….. This was an unforeseen event and not a deliberate act of misconduct.
In this connection, I would like to draw your attention to Para II of M.F. O.M. No. 19043/2/89-E-IV dated 30.05.1990, which stipulates that a second medical opinion should be sought only in genuine cases, particularly for employees with a history of frequent medical leave. This is my first instance of such absence, making the request for a second opinion unwarranted.
Furthermore, Para 3 of GID 4 below Rule 25 of The CCS (Leave) Rules, 1972, as circulated vide DOPT OM No. 13026/3/2010-Esstt.(Leave) dated 22.06.2010, mandates that in cases of unauthorized absence, the government servant must be informed of the consequences and directed to rejoin duty immediately or by a specific date. I did not receive any such intimation regarding the consequences of my absence, except for the current request for explanation. As a new recruit, I was unaware of these procedures.
Moreover, Para 3 of DOPT OM No. 11013/7/94-Estt(A) dated 18.05.1994 states that separate permission may not be required if the government servant has indicated their intention to leave the headquarters/station, along with their leave address, when applying for leave. I had clearly indicated my intention to leave and provided my leave address on the envelope sent via Registered Post No. ………Dated ………..
In conclusion, my absence was due to sudden illness and the need for medical treatment at the District Head Quarter, which should not be considered an act of indiscipline. I respectfully request that you consider my explanation and drop any further action against me.
