87. Who is eligible for special maternity leave ??
(DOPT OM no. No.13018/1/2021-Estt.(L) dtd 02.09.2022)

Eligibility:
• Applicable to female Central Government servants with less than two surviving children.
• The delivery must have taken place in an authorized hospital (Government or CGHS-empanelled).
• In emergencies, a certificate is required for deliveries in non-empanelled hospitals.

Duration & Conditions:
• 60 days of Special Maternity Leave from the date of stillbirth or the child’s death (within 28 days after birth).
• If maternity leave was already availed, it will be converted into another type of leave (without a medical certificate), and 60 days of Special Maternity Leave will be granted from the date of the child’s death.
• If maternity leave was not taken, the 60-day Special Maternity Leave will start from the date of stillbirth or the child’s death.

Definitions:
• Stillbirth: A baby born with no signs of life at or after 28 weeks of gestation.
• Death Soon After Birth: Defined as the child's death within 28 days of birth.
