122. Whether the CATs/Courts have power to direct promotion of a person?

The courts or Tribunals cannot direct promotions of a person, but can merely direct for consideration/reconsideration of a person or a case in accordance with law.

123. Whether any rosters required to be maintained for adhoc appointments by way of promotions for a period of 45 days or more.

No formal rosters for adhoc appointment needs to be maintained.

124. Whether any formal reservation is applicable in granting adhoc promotions?

Even though no formal reservation is available in such promotions, Adhoc promotions which are considered only against vacancies in excess of 45 days are necessarily to be placed on the appropriate roster points points. It should be considered on the basis of their general seniority as per the gradation list on the principle of seniority cum fitness. No separate formal roster need be maintained for adhoc promotion and a simple register will be sufficient.

125. If one adhoc promotion is replaced by regular promotion, who will be reverted first; whether the incumbent or the junior most in the adhoc arrangements?

In such cases, it should be strictly in the reverse order of seniority, the junior most candidates being reverted first; no special concession is to be given to SC/ST candidates at the time of such reversion.

126. Whether the option facility is available for achoc promotion?

No. It is available only on regular promotions and not on adhoc promotions. However, if an adhoc promotion is followed by regular promotion without break it may be allowed as from the date of initial appointment to the higher post.
