What mandatory procedure must an administrative Ministry or Department follow if they wish to introduce substantial changes to draft Recruitment Rules (RRs) or Service Rules (SRs) after receiving the formal advice of the Union Public Service Commission (UPSC)?
If an administrative Ministry or Department intends to make any substantial changes to the draft Recruitment Rules or Service Rules after the UPSC has already rendered its advice, it is mandatory to refer the proposal back to the UPSC to obtain their fresh advice and concurrence before final notification.
The Department of Personnel and Training (DoPT) clarifies that "substantial changes" are those that have a direct bearing on the core principles of recruitment, such as altering the prescribed method of recruitment or modifying the eligibility criteria. This requirement does not, however, apply to pure vetting changes directed by the Legislative Department, or simple spelling and grammatical corrections. Notifying rules with substantial changes without returning to the Commission will be officially treated as a serious case of disagreement with the UPSC.
