Can an appointment on compassionate grounds be transferred to another family member, or can the appointee request a change to a higher post later?
The legal framework views the "emergency" as a one-time event that is resolved once an appointment is accepted. According to DoP&T O.M. No. 14014/02/2012-Estt.(D) dated 30.05.2013, an appointment made on compassionate grounds cannot be transferred to any other person under any circumstances. Additionally, once a person has been appointed to a particular post, the circumstances that led to the appointment are deemed to have ceased to exist. Consequently, any subsequent request for appointment to a higher post or a different post based on the same compassionate grounds must be invariably rejected. The appointee is expected to progress in their career based on the same promotion and merit rules as their colleagues.
