Can an application for compassionate appointment be rejected based on the passage of time since the employee's death or the receipt of terminal benefits?
The primary objective of the scheme is to provide immediate relief from financial destitution. According to DoP&T O.M. No. 14014/02/2012-Estt.(D) dated 30.05.2013, while there is no absolute time limit for considering an application, "belated requests" are viewed with caution. The fact that a family has managed to survive for many years after the death or medical retirement of the employee is generally taken as adequate proof that the family possessed some dependable means of subsistence, which may weaken the claim for compassionate relief. However, an application cannot be rejected solely because the family received terminal benefits under various welfare schemes (such as insurance or GPF). Similarly, an application cannot be denied or delayed due to administrative reorganizations within the Ministry or Department. Once a person is appointed to a particular post on compassionate grounds, the "emergency" is legally considered to have ceased, and they cannot be considered for another post or higher grade on compassionate grounds later in their career.
