How does the 5% quota restriction function in small cadres or Ministries, and what "liberalized" mathematical methods are permitted to locate vacancies?
Compassionate appointments are strictly limited to 5% of the vacancies falling under the direct recruitment quota in Group 'C' posts for a given recruitment year. For small offices where fewer than 20 direct recruitment vacancies arise annually, DoP&T O.M. No. 14014/02/2012-Estt.(D) dated 30.05.2013 allows for several Group 'C' posts to be grouped together to calculate the 5% quota, provided the total compassionate appointments in any one post do not exceed one. Furthermore, "Small Ministries"—defined as those that have been unable to locate a vacancy under the 5% quota for the last three years—may apply a more liberalized calculation method. These organizations can total the direct recruitment vacancies arising over three or more preceding years and calculate 5% of that grand total to locate a single vacancy. This is permitted only if no other compassionate appointment has been made by that Ministry or Department during the years being grouped.
