61. What was the subject of the order dated November 25, 2004, and under what conditions could overpayment be recovered from Postmen/Mail Guards?
The subject of the order, with number No. 2-14/2002-PCC and dated November 25, 2004, was "Overpayment to Postmen/Mail Guards - Verification of records".
The order was issued in response to a case filed by the All India Postal Employees Union, Postmen and Group 'D' against the recovery of overpayment. The Principal Bench of the CAT, Delhi, passed a final judgment on September 13, 2004, which outlined the conditions for recovery.
Based on the judgment and the Office Memorandum dated October 14, 1997, recovery of overpayment could be effected only if the employees had submitted a written undertaking to refund any excess payment made due to incorrect pay fixation. If no such undertaking was obtained from the employee, the respondents were not entitled to recover any overpayment, and any amount already recovered was to be refunded.
The order also specified that if the undertaking was not obtained by the Drawing and Disbursing Officer, the responsibility should be fixed, and recovery should be effected from the officers at fault. Heads of Circles were instructed to verify their records and act accordingly.
This was modified by the Postal JCA and dropped the recovery
