56. Model Representation – Against filing FIR for the temporary misappropriation of Rs.3000
One official was charge sheeted and removed from serviced for the misappropriation of Rs.3000 in a case. Subsequently on appeal. This punishment was reduced and reinstated in to service. But the SPOs filed a FIR in the Police station. The following was the draft sent at that time.
Sub: Request for Intervention Regarding Police Complaint Lodged by SPOs ……….
Respected Sir,
I am writing to you with deep concern and a plea for your urgent intervention regarding a police complaint lodged against me by the SPOs, …………. division.
I was previously subjected to Rule-14 memorandum proceedings, which culminated in my removal from service by the appellate authority. However, through the compassionate intervention of the Hon'ble PMG, my punishment was reduced, and I was provided an opportunity to rejoin the department, as per order No. …………….. I remain profoundly grateful for this second chance to rebuild my life and career.
Despite this, I have now been informed that the SPOs, ………….., have lodged a police complaint against me concerning an alleged misappropriation of ₹3,000. This complaint pertains to the very same case for which I have already faced disciplinary action and punishment, as outlined in the aforementioned appellate order.
I respectfully draw your attention to the Directorate's order No. 8-1/Rulings/2014-INV(Part) dated 08-11-2017, which stipulates that police complaints should only be lodged in cases of loss and fraud exceeding ₹50,000. The SP, ………….., appears to have acted in contravention of this directive by filing an FIR against me (FIR No. ………….. at ………..Police Station) for a significantly smaller amount.
I have already endured substantial mental anguish, financial strain, and the loss of service due to the initial disciplinary proceedings. To now face a police complaint and potential criminal prosecution for the same matter, especially for such a meagre amount, undoubtedly constitutes double jeopardy. This action by the SPOs threatens to devastate not only my life but also the well-being of my entire family. Furthermore, it appears to be a clear violation of natural justice and the existing Directorate's guidelines.
Therefore, with utmost humility and folded hands, I earnestly implore your kind self to direct the SPOs, …………., to withdraw the police complaint registered against me. Your timely intervention in this matter would be immensely appreciated and would prevent irreparable harm.
