 Rule 38 Transfer Regulations 

• This document summarizes the regulations governing Rule 38 transfers:

• Eligibility: Employees must have completed one year of service in the cadre to be eligible for a Rule 38 transfer. (Clarification to the letter dated 17.11.2021)

• Frequency: Rule 38 transfers will be considered quarterly, in March, June, September, and December, instead of monthly. (Change to the letter dated 31.12.2021)

• Relieving Period: Officials approved for a Rule 38 transfer must be relieved within 20 days.

• Time Limit for Relieving at Request: The 90-day time limit for relieving at an employee's request (as per the letter dated 12.10.2022) has been reduced to 60 days. After 60 days, the transfer request will be removed from the database.

• Disciplinary Charges: Officials facing disciplinary charges will not be relieved until the proceedings are finalized.

விதி 38 இடமாற்ற விதிமுறை

• இந்த ஆவணம் விதி 38 இடமாற்றங்களைக் கட்டுப்படுத்தும் விதிமுறைகளைச் சுருக்கமாகக் கூறுகிறது:

• தகுதி: விதி 38 இடமாற்றத்திற்குத் தகுதியுடையவராக இருக்க, ஊழியர்கள் பதவியில் ஒரு வருடம் சேவை முடித்திருக்க வேண்டும். (17.11.2021 தேதியிட்ட கடிதத்திற்கான தெளிவுபடுத்தல்)

• விதி 38 இடமாற்றங்கள் மாதந்தோறும் என்பதற்கு பதிலாக காலாண்டு அடிப்படையில், மார்ச், ஜூன், செப்டம்பர் மற்றும் டிசம்பர் மாதங்களில் பரிசீலிக்கப்படும். (31.12.2021 தேதியிட்ட கடிதத்திற்கான மாற்றம்)

• விடுவிப்பு காலம்: விதி 38 இடமாற்றத்திற்கு அங்கீகரிக்கப்பட்ட அதிகாரிகள் 20 நாட்களுக்குள் விடுவிக்கப்பட வேண்டும்.

• கோரிக்கையின்படி விடுவிப்பதற்கான கால வரம்பு: ஊழியரின் கோரிக்கையின்படி விடுவிப்பதற்கான 90 நாள் கால வரம்பு (12.10.2022 தேதியிட்ட கடிதத்தின்படி) இப்போது 60 நாட்களாகக் குறைக்கப்பட்டுள்ளது. 60 நாட்களுக்குப் பிறகு, இடமாற்றக் கோரிக்கை தரவுத்தளத்திலிருந்து நீக்கப்படும்.

• ஒழுக்காற்று குற்றச்சாட்டுகள்: ஒழுக்காற்று குற்றச்சாட்டுகளை எதிர்கொள்ளும் அதிகாரிகள் நடவடிக்கைகள் முடிவடையும் வரை விடுவிக்கப்பட மாட்டார்கள்.
