Implementation of Hon'ble CAT (PB), New Delhi Order dated 20.09.2023 in OA No. 3466/2019.
• The Principal Bench in the OA No. 3466/2019 directed Department to count service rendered under RTP (Regular Temporary Status) for consequential benefits.
• The Department's challenge was dismissed on 10.12.2024.
• Contempt Petition No. 377/2024 was filed. Department admitted to concealing facts regarding previous OAs (No. 779 & 780 of 2013). Misc. Application dated 15.04.2015 established the present order.
• The Department made a Reference to Civil Appeal No. 7268/1997 (K. N. Sivadas).
• MA petition was filed again on 17.03.2024: Department ordered to implement orders and file compliance affidavit.
• Now, Postal Directorate issued letter on 22.04.2025 for implementation, subject to record availability/production by applicants.
• It is held that Hon'ble CAT (PB) judgment (20.09.2023) is final and must be implemented. Applicants are entitled to "all consequential benefits including MACP and pension," fixed according to RTP entry date, subject to eligibility.
• Payments are subject to pre-audit by DAP. This order shall not be treated as precedent in any other case.
