140. What is the effect of written warning kept in the ACR? Whether it shall be communicated to official and provide an opportunity to represent?
Where a copy of the warning is kept on the confidential report dossier, it will be taken to constitute an adverse entry and the officer so warned will have the right to represent against the same in accordance with the existing instructions relation to communication of adverse entries.

141. Whether Annual confidential report of Group C staff shall be written by another Group ‘C’.
The practice has been discontinued vide DGP&T No. 27/17/75-Disc dated 05.12.1978. it should be written only by Gazetted officers.
142. Since when the entire remarks in the APAR is being conveyed to the officer reported upon for representation, if any ?
From the report for 2008-09 onwards.
143. What is the time limit for making representations against adverse entry?
As per the old rules, only one representation against adverse entries should be allowed within one month of their communication. Even belated representations may be considered if there is a satisfactory explanation for the delay vide DOPT orders dt. 31.10.61. An appeal against rejection of representation against adverse entries can be made within six months after such rejection. Now the CR system has been modified as APAR (Annual Performance Assessment Report. As per the new schemes only 15 days time from the receipt of communication has been provided.
