Appeal for Review and Revocation of Suspension Order
I respectfully submit this appeal against the order of suspension issued by the Superintendent of Post Offices, ……….. Division, vide Memo No. F1/……….. dated……...
I was placed under suspension in connection with pending disciplinary proceedings.
My appeal concerns the following:
1. I submit that my suspension is unjustified. The suspension order, which cites the pendency of disciplinary proceedings, is prejudicial and violates the principles of natural justice, as it was issued without assigning specific reasons.
2. I contend that the officers entrusted with the responsibility of conducting a thorough verification have unduly delayed the disciplinary proceedings against me, rather than expediting the process to ascertain the facts. This delay is unjust.
3. I assert that I have not caused any monetary or financial loss to the Department. Furthermore, no charges have been formally framed against me to date.
4. This appeal is made under clause (i) of Rule 23 of the CCS (CCA) Rules, 1965.
(A) Facts of the Case:
(i) While working as a Postal Assistant in the office of ………..., I was placed under suspension with effect from …………, under the provisions of Sub-rule (1) of Rule 10 of the CCS (CCA) Rules, in contemplation of disciplinary proceedings.
(ii) To date, no departmental proceeding has been instituted against me through the issuance of a charge sheet.
(iii) The suspension order is liable to be revoked based on the grounds outlined below.
(B) Grounds for Revocation of Suspension:
(i) Despite the passage of over one year since the suspension order, no disciplinary proceedings have been initiated against me through the issuance of a charge memo.
(ii) The instructions of the Government of India, as detailed in Department of Personnel & Training (DoPT) O.M. No. 11012/4/2003-Estt.(A), dated 07.01.2004, stipulate that if an official remains under suspension for one year without the issuance of a charge sheet in a departmental inquiry, the official should ordinarily be reinstated without prejudice to the case. This directive has not been followed in my case.
(C) Relief Sought:
I respectfully request that, in accordance with the aforementioned Government of India instructions, the suspension order be revoked by the Appellate Authority, in exercise of the powers vested under Sub-rule (1) of Rule 27 of the CCS (CCA) Rules, considering the specific circumstances of my case.
