19. What is deemed suspension?
A deemed suspension is an order of suspension issued by the Appointing authority with effect from a retrospective date in the following circumstances: -
(a) When the official is detained in custody on a criminal charge or otherwise for a period exceeding 48 hours.
(b) When the official is convicted and sentenced to a term of imprisonment exceeding 48 hours and if he is not dismissed/removed/compulsorily retired forthwith.
(c) When a dismissed/removed/compulsorily retired official who was under suspension at the time of dismissal etc is set aside in appeal or on review and ordered further enquiry etc and
(d) When such penalty of dismissal etc is set aside by a court of law and the authority decides to proceed further.

20. Has an order of suspension been appealable?
Yes. As per Rules 23 (i) an appeal can be preferred to the authority specified in the schedule.

21. How long the suspension can continue?
An order of suspension can continue to remain in force if it is extended after review for a further period before the expiry of 90 days till it is revoked by the authority competent to do so, or till the date of dismissal removal etc, when such penalties are imposed while under suspension.

19. கருதப்பட்ட இடைநீக்கம் என்றால் என்ன?
• கருதப்பட்ட இடைநீக்கம் என்பது பின்வரும் சூழ்நிலைகளில் முந்தைய தேதியிலிருந்து அமலுக்கு வரும் வகையில் நியமன அதிகாரியால் வழங்கப்படும் இடைநீக்க உத்தரவு ஆகும்: 
o (a) அதிகாரி 48 மணி நேரத்திற்கு மேல் குற்றவியல் குற்றச்சாட்டு அல்லது வேறுவிதமாக காவலில் வைக்கப்படும்போது.
o (b) அதிகாரி 48 மணி நேரத்திற்கு மேல் சிறைத்தண்டனை விதிக்கப்பட்டு தண்டிக்கப்படும்போது மற்றும் அவர் உடனடியாக பணிநீக்கம்/நீக்கம்/கட்டாய ஓய்வு பெறவில்லை என்றால்.
o (c) பணிநீக்கம்/நீக்கம்/கட்டாய ஓய்வு நேரத்தில் இடைநீக்கத்தில் இருந்த பணிநீக்கம்/நீக்கம்/கட்டாய ஓய்வு பெற்ற அதிகாரி மேல்முறையீட்டில் அல்லது மறுஆய்வில் ரத்து செய்யப்பட்டு மேலும் விசாரணை போன்றவை உத்தரவிடப்படும்போது.
o (d) அத்தகைய பணிநீக்கம் போன்ற தண்டனை நீதிமன்றத்தால் ரத்து செய்யப்பட்டு, அதிகாரி மேலும் தொடர முடிவு செய்யும் போது.

20. இடைநீக்க உத்தரவு மேல்முறையீடு செய்யக்கூடியதா?
• ஆம். விதி 23 (i) இன் படி, அட்டவணையில் குறிப்பிடப்பட்டுள்ள அதிகாரியிடம் மேல்முறையீடு செய்யலாம்.

21. இடைநீக்கம் எவ்வளவு காலம் தொடரலாம்?
• இடைநீக்கம் செய்யும் அதிகாரி ரத்து செய்யும் வரை அல்லது இடைநீக்கத்தில் இருக்கும்போது அத்தகைய தண்டனைகள் விதிக்கப்படும்போது பணிநீக்கம் நீக்கம் போன்ற தேதி வரை, 90 நாட்கள் காலாவதியாகும் முன் மறுஆய்வுக்குப் பிறகு மேலும் காலத்திற்கு நீட்டிக்கப்பட்டால், இடைநீக்க உத்தரவு அமலில் இருக்கும்.
