9. Fixation of pay and grant of increment in the revised pay structure – clarifications – regarding.

Gist of the orders

• This document clarifies pay fixation and increment rules under the Central Civil Services (Revised Pay) Rules, 2016.

• Option for Pay Fixation: Employees promoted between January 1, 2016, and the notification date of the revised pay rules (July 25, 2016) who initially opted for pay fixation on their next increment date can now revise their option. Due to the changed circumstances after the new rules, this revision must be done within one month of the issuance of this clarification, and this revised option will be final.

• Increment on 01.01.2016: Employees appointed/promoted or granted financial upgrades between January 2, 2015, and July 1, 2015, are not entitled to an increment on January 1, 2016, when their pay is fixed in the revised pay structure, as the revised rules are effective from that date.

• இந்த ஆவணம் மத்திய குடிமைப் பணிகள் (திருத்தப்பட்ட ஊதியம்) விதிகள், 2016 இன் கீழ் ஊதிய நிர்ணயம் மற்றும் ஊதிய உயர்வு விதிகளை தெளிவுபடுத்துகிறது.

• ஊதிய நிர்ணயத்திற்கான விருப்பம்: ஜனவரி 1, 2016 மற்றும் திருத்தப்பட்ட ஊதிய விதிகள் அறிவிக்கப்பட்ட தேதிக்கும் (ஜூலை 25, 2016) இடையே பதவி உயர்வு பெற்ற ஊழியர்கள், ஆரம்பத்தில் தங்களது அடுத்த ஊதிய உயர்வு தேதியில் ஊதிய நிர்ணயம் செய்ய விருப்பம் தெரிவித்திருந்தால், இப்போது தங்கள் விருப்பத்தை மாற்றிக் கொள்ளலாம். புதிய விதிகள் காரணமாக சூழ்நிலைகள் மாறியுள்ளதால், இந்த தெளிவுபடுத்தல் வெளியிடப்பட்ட ஒரு மாதத்திற்குள் இந்த திருத்தம் செய்யப்பட வேண்டும், மேலும் இந்த திருத்தப்பட்ட விருப்பம் இறுதியானது.

• 01.01.2016 அன்று ஊதிய உயர்வு: ஜனவரி 2, 2015 மற்றும் ஜூலை 1, 2015 க்கு இடையில் நியமிக்கப்பட்ட / பதவி உயர்வு பெற்ற அல்லது நிதி மேம்படுத்தல்கள் வழங்கப்பட்ட ஊழியர்கள், திருத்தப்பட்ட ஊதிய கட்டமைப்பில் அவர்களின் ஊதியம் நிர்ணயிக்கப்படும் போது, ஜனவரி 1, 2016 அன்று ஊதிய உயர்வு பெறத் தகுதியற்றவர்கள், ஏனெனில் திருத்தப்பட்ட விதிகள் அந்த தேதியிலிருந்து அமல்படுத்தப்படுகின்றன.

Fixation of pay and grant of increment in the revised pay structure – clarifications – regarding.

Following the notification of Central Civil Services (Revised Pay) Rules, 2016, this Department has received references seeking clarifications regarding various aspects of fixation of pay in the revised pay structure as also pay fixation and grant of increment in future under revised pay structure. The matter has been considered in this Department and the points of doubts are clarified as under:

1. Point of doubt: As per the provisions of FR22 (l) (a) (1), the Government servants (other than those appointed on deputation to ex-cadre post or ad hoc basis or on direct recruitment basis) have the option, to be exercised within one month from the date of promotion, to have the pay fixed under this rule from the date of such promotion/ appointment or from the date of next increment.

Some of the employees, promoted between 01.01.2016 and the date of notification of CCS (RP) Rules, 2016 had opted for their pay fixation on promotion/financial up-gradation under MACPS from the date of their next increment in the lower grade. Consequent upon notification of CCS (RP) Rules, 2016 i.e. 25th July, 2016, the option submitted by such employees has now turned out to be disadvantageous. Whether such employee may be allowed to revise their option under FR 22 at this stage?

Clarification: Under the changed circumstances after notification of CCS (RP) Rules, 2016, the employee may be allowed to exercise revised option for fixation of pay under FR22 (l) (a) (1), such revised option shall be exercised within one month of issue of this 0M. Option so revised, shall be final.

2. Point of doubt: Whether employees appointed/promoted/ during granted financial up-gradation 02.01.2015 and 01.07.2015 will be entitled to grant of one increment on 01.01.2016.

Clarification: Since the provisions of CCS (RP) Rules, 2016 are effective from 01.01.2016, no increment shall be allowed on 01.01.2016 at the time of fixation of pay in the revised pay structure.
