This situation involves an FIR filed for the alleged misappropriation of Rs. 3,000, for which the official has already been subjected to disciplinary proceedings and received a punishment. Current regulations stipulate that filing a police complaint is unnecessary for misappropriated amounts less than Rs. 50,000.
Subject: Request for Intervention - Withdrawal of Police Complaint - submitted
I respectfully request your urgent intervention regarding a police complaint lodged against me by the SPOs, ………… Division. This complaint pertains to the same incident for which I have already been disciplined and for which I received a reduced penalty upon appeal.
I was initially proceeded against under a Rule-14 memorandum and awarded with the stoppage of increment without cumulative effect for two years, and the appellate authority subsequently enhanced my punishment to removal from service. I am deeply grateful to the Honorable PMG for, upon my petition, reducing this punishment to a lesser penalty of withholding the increment for one year considering my plea. This decision provided me with the opportunity to continue serving in the department and rebuild my life.
However, despite this resolution, the SPOs, ……….., have now filed a police complaint against me, alleging misappropriation of Rs. 3,000/- related to the very same incident. This action is particularly concerning given Directorate order No. 8-1/Rulings/2014-INV(Part) dated 8-11-2017, which clearly stipulates that police complaints against officials should only be lodged in cases involving losses and frauds exceeding Rs. 50,000/-. The SP, ………….., has disregarded this directive by filing a complaint against me for a significantly smaller amount, resulting in an FIR registered under No………… at ………. Police Station.
I have already faced disciplinary action for this matter, enduring considerable mental anguish, financial losses, and a period of service disruption. To be subjected to further legal proceedings for the same incident, especially involving such a small sum, constitutes double jeopardy and is a severe injustice. This action by the SPOs threatens to devastate not only my life but also the lives of my family members. It is a clear violation of natural justice and a direct contravention of existing Directorate orders.
Therefore, with utmost respect, I implore you to direct the SPOs, ………., to withdraw the police complaint filed against me. I humbly request your kind and immediate attention to this matter.
Thank you for your consideration.
