Implementation of Court Judgments

• Following the 49th JCM meeting, a list of court judgments delivered in favour of employees is submitted so that benefits can be extended to all similarly placed workers to avoid repetitive lawsuits. 

• OT Wages (Ministry of Defence): Supreme Court judgment for inclusion of allowances like HRA, CCA, TA, and SFA when calculating Overtime (OT) wage arrears under the Factories Act 1948. 

• Delhi High Court orders concerning higher pay scales for Assistants and Stenographer Cadres at par with Central Secretariat staff. 

• Request to extend Dress Allowance to all similarly placed industrial employees instead of limiting it solely to the active court petitioners. 

• Supreme Court order noting that denying pay parity to lower formations compared to CSS is discriminatory under Article 14. 

• High Court of Madras ruling that placing personnel in Highly Skilled Grade-I is an upgrade, not a promotion, making them eligible for subsequent MACP benefits. 

• Request to issue guidelines paying NDA on the actual 7th CPC basic pay scale, expanding upon a previous Supreme Court decision implemented under the 6th CPC. 

• Various other CAT and High Court rulings concerning the 3rd MACP with higher grade pays and revised initial pay structures under the 6th CPC. 

• Non-implementation of these judgments violates the National Litigation Policy. The JCM Chairman is requested to instruct the Ministry of Defence to issue uniform government orders and hold a meeting with the Staff Side.
