Granting Compensatory Off (C-OFF) to Staff Car Drivers in the Department of Posts.
The Central Public Information Officer (CPIO) identifies three primary documents governing C-OFF for Staff Car Drivers:
i. Department of Posts OM dated 12.11.2020: A foundational directive that instructs all Heads of Circles to follow DOPT and Ministry of Finance guidelines.
ii. DOPT OM dated 19.03.1991: General instructions regarding allowances and compensatory leave.
iii. Ministry of Finance OM dated 11.08.1976: Early foundational rules regarding compensatory off.
• There is no specific rule or OM exclusively dealing with the eligibility of drivers for C-OFF when performing operational duties beyond prescribed hours.
• Similarly, there is no rule on record that explicitly prohibits granting C-OFF for long operational duties.
• The CPIO stated there is no specific rule saying that claiming both Overtime Allowance (OTA) and Daily Allowance (DA) makes a driver ineligible for C-OFF.
• However, general instructions indicate that compensatory leave and overtime allowance are ordinarily not admissible simultaneously.
• The Directorate’s OM dated 12.11.2020 does not contain any provision denying C-OFF to Staff Car Drivers; it simply reiterates that Circles must adhere to established DoPT/MoF instructions.
• Regarding whether local administration can deny C-OFF due to "staff shortage," the CPIO declined to provide an opinion or interpretation, stating that such information (interpretations) is not "information" as defined under Section 2(f) of the RTI Act unless already available on record.
