Rules, Rights & Rites -21 Submission of life certificates by both parents in case of enhanced family pension

Clarification regarding the submission of life certificates by both parents in case of enhanced family pension payable to them under CCS (EOP) Rules, 1939/2023.
• Family pension to parents is admissible when the Government servant dies as a bachelor, a widower without children, or is not survived by an eligible widow/widower or child.
• Enhanced Rate (2023 Rules - Categories 'C' & 'D'):
o 75% of the family pension entitled to a widow if both parents are alive.
o 60% of the family pension entitled to a widow if only one parent is alive.
• The payment of family pension to parents under the 2023 Rules (Category 'C' & 'D') is without reference to the amount of their income from other sources.
• The family pension, wherever admissible, is payable first to the mother of the deceased Government servant, and failing her, to the father.
• The enhanced family pension is paid at a higher rate (75%) when both parents are alive, and at a lower rate (60%) when only one is alive. Currently, there is no provision for both parents to submit Life Certificates. This has resulted in the continuation of the higher rate even after the death of one parent in a few cases, leading to overpayment.
• It has been decided that henceforth, Life Certificates in such cases (where both parents are alive and receiving enhanced family pension) will be submitted by both the parents every year to avoid overpayment in case of the demise of one of the parents.
