766. Additional Documents/Witnesses
During the Preliminary Hearing, Inquiring Authority should also advise the Charged Official to:
(a) submit a list of witnesses to be examined on his behalf with their addresses indicating what issues they will help in clarifying; and
(b) submit a list of additional defence documents which the Charged Official may wish to produce in his defence, indicating the relevance of the documents and the custodians thereof.
The time limit within which the lists of additional documents and defence witnesses should be submitted by the Charged Official should be fixed, but it will be desirable to reckon the limit from the date of completion of inspection of prosecution documents by the Charged Official. The Charged Official should be advised to endorse a copy of the lists to the Presenting Officer also. [Para 3-6 of Chapter XI of CVC Vigilance Manual, Vol. 1 (Fifth Edition)]
767. Daily Order Sheet (DOS)
Salient aspects of DOS are explained below:
The Inquiring Authority (IA) should maintain Daily Order Sheet in which business transacted in each hearing should be recorded in brief, under his signature. Inquiring Authority will have to modify the text/content as per requirement of each proceedings, which are unique in each case. This form is to be used for every hearing, indicating the business transacted, the decisions taken regarding adjournment, proceedings, etc. and should be in the nature of date-wise record of the case. This is like a noting sheet on the left side of the case file. A gist of the representations made by either party i.e. Presenting Officer or Charged Official and the orders passed thereon should also be recorded therein. Signatures of Presenting Officer, Charged Official, and Defence Assistant may be obtained. A copy may be handed over to both Presenting Officer and Charged Official (and not to Defence Assistant).
All that transpires in the hearing, including the directions given to the Presenting Officer/Charged Official and the time-schedule laid down for inspection of documents etc., should be recorded in a Daily Order Sheet and a copy of each should be made available to the Presenting Officer and the Charged Official after obtaining their signatures thereon. Inquiring Authority too has to sign on the Daily Order Sheet. If the Presenting Officer and/ or Charged Official(s) are/is not present, copies of the order sheet should be sent to the absent Presenting Officer and/or Charged Official(s) immediately after the Preliminary Hearing by registered post. DOS will also be signed by the Defence Assistant though he will not be given copy of DOS. (Para 22 of Chapter XI of CVC Vigilance Manual, Vol. 1 (Fifth Edition)]
