The following gist is given below for keeping memory purpose of all the important rules covered under PO Guide Part I as per the syllabus. Please read again and again and keep memory of the following gist of rules in PO Guide Part I.
7. Fraudulent Use of Stamps (Regulation 9)
• Penalties: Unauthorized sale or breach of terms regarding stamps is punishable by law.
• Reusing postage stamps fraudulently or to cause loss to the Government is an illegal and punishable offense.
• If such a fraudulently used postage stamp is detected on an item already posted, the item will not be delivered and will be dealt with as specified by administrative instructions.
• Manner of Dealing: If a previously used postage stamp (from which no attempt was made to remove obliteration marks) is detected on an already posted item, or if a service stamp (from which no attempt was made to remove service letters) is detected on a private item, the stamp shall be ignored.
• In such cases, the item will be charged with the postage it thus becomes liable for and forwarded to its destination with a remark explaining the charge; a note of the occurrence will be made in the error book for post offices or in the note book for mail offices.
• If such an item is handed in at the window, it will be returned to the presenter with the remark that a previously used postage stamp or a service stamp affixed on a private item cannot be recognized as payment of postage or any other charge.
• Unrecognized Stamps: Postage stamps (adhesive, embossed, impressed, or printed) that have been defaced, obliterated, or marked (e.g., with rubber stamps, pen marks, or unauthorized printing) will not be recognized for payment.
• Stamps separated from embossed envelopes, postcards, or wrappers, or those that are torn, cut, or otherwise rendered imperfect, will also not be recognized.
• When such stamps are found affixed to an item, they should not be defaced, but a remark stating why they have been ignored should be written on the item.
• Note 1: There is no prohibition against using postage stamps perforated with initials or other identifying marks traced in minute holes for payment of postage or postal fees.
• Note 2: Postage stamps must be affixed to an item by the sender or their messenger, and in no case by Department officials.
8. Illegal Manufacture or Usage of Postage Stamps (Regulation 10)
• Forged, counterfeit, or fictitious postage stamps are punishable under applicable law.
• The manufacture and use of fictitious postage stamps for any purpose is prohibited and is an offense punishable under Section 186 of Bharatiya Nayaya Sanhita, 2023.
• Reproduction of Stamps: Reproduction of stamps is only allowed for illustration purposes in a philatelic publication, or in a section related wholly to postage stamps within a general publication.
• Such reproduction must be in black only.
• For color reproduction for publicity purposes, prior permission from the Secretary, Department of Posts, must be obtained.
• To avoid similarity with actual postage stamps, reproductions must be distinctly smaller or larger than the actual stamp and without perforations on the edges.
• A crossbar must also be placed on one corner of the stamp, obliterating the denomination.
• Reproduction of a stamp in color, at the actual size, with perforations on the edges, may be deemed as the production of an actual stamp, which is a punishable offense under Section 186 of Bharatiya Nayaya Sanhita, 2023.
• Sovereign Privilege: Issuing a postage stamp is the sovereign privilege of the Department of Posts.
• Requests for stamp images for non-commercial purposes (e.g., autobiographies, textbooks, philately promotion literature) are decided by the Department of Posts on a case-by-case basis.
• Requests involving substantial pecuniary or direct benefit to an individual or organization are also decided on a case-by-case basis.
• When using stamp images in any book, publication, or research paper, the publisher/author must add a disclaimer in the foreword stating that the views expressed are their own and not those of the Department of Posts, and that the Department bears no legal responsibility for any controversy or legal problem.
• An undertaking stating that no anti-national, anti-social, anti-religious, or seditious material is used in the publication must be submitted to the Department of Posts when requesting permission to use stamp images.
• The Department of Posts should be properly acknowledged for granting permission to use stamp images and related information.
• The size of the reproduced stamp must be larger or smaller than the existing size in accordance with the rules.
• Publishers/individuals/organizations are required to provide samples of the product using stamp images for the Department of Posts' records.
• A brief write-up on India Post or the specific postage stamp used should invariably accompany the images.
