151. One postman who uses to wear uniform regularly but he was caught by the divisional head one day for not wearing uniform. He ordered to treat the day as Dies non. Will it be correct?

Absolutely wrong. As per the Dept’s letter dt. 27.03.2002, the official after three defaults shall alone be liable for disciplinary action and may not be accepted for duty and can, in addition, be debarred from the supply of uniforms. There is no provision to issue “Dies non” for the reason of not wearing of uniforms.

152. Whether any time limit is prescribed for disposal of representations received from employees?

Yes. As per the Dte letter no. 201/40/75-Disc dt. 23.07.75, the staff representations should be dealt with in the following manner: -

(i) Action must be taken within a week

(ii) The decision may be taken within a fortnight and

(iii) At any rate, the decision must be taken within a month.

It provides further that the appeal should be decided within a month from the date of receipt of the records of the case.

However, this time limit has not been observed anywhere since there is no penal provision is provided in the rules as if available in R.T.I. Act 1995 for belated reply and non response.

153. Is the Service Book of an official is a secret one? Is there any provision to verify the entries therein by the officials?

According to DG’s orders below SR 202, it is incumbent on every Government Servant to see that his service is properly maintained. He should be allowed to verify the entries periodically and in token of having accepted the entries made therein, he should affix his signature in the service book.

It is necessary that one should verify the service book every year and check the service entries and leave accounts at Head Post office.

A certified copy of Service book can also be obtained on quitting the service on payment of Rs.5/-. As per the latest orders the account office should maintain duplicate service book which shall be handed over to the employee and every year the employee should update the entries.
