 58. Model Representation - One official is being kept under suspension over five months without issuing the charge sheet or reason for the suspension. He made this representation.

Sub: Appeal Against prolonged Suspension Order beyond three months without stating the reasons – request immediate reinstation

Sir,

I am submitting with deep respect to appeal against my suspension, effective 12.12.2024, as communicated via Memo No. ……………. Initially, the grounds for this action were unclear to me. While I sought clarification promptly, the response indicated the reason was stated in the suspension memo itself, which mentions a contemplated/pending disciplinary proceeding. Subsequently, my suspension has been extended for an additional 90 days.

As per the Department of Personnel and Administrative Reforms guidelines, if a charge sheet is not issued within three months of suspension, the reason for the continued suspension should be communicated. The DoPT Office Memorandum No. 11012/17/2013-Estt.A-III dated 2nd January 2014, which states:

"It has now been decided that where a Government servant is placed under suspension, the charge sheet should be issued within three months from the date of suspension. If the charge sheet is not issued within this period, the reasons for delay should be recorded in writing by the Disciplinary Authority. The Government servant concerned may also be informed of the reasons for delay."

However, despite this timeframe having passed, I have yet to receive a charge sheet or a specific explanation for my ongoing suspension This lack of information has prevented me from adequately addressing the concerns, as I remain unaware of the precise allegations against me. Furthermore, I have not been afforded any opportunity to present my side of the story through a recorded statement or an inquiry. I have come to understand that this significant action of suspension was initiated based solely on an anonymous complaint.

The extended period of suspension has created considerable hardship for me and my family. I reside in a rented accommodation with my wife, incurring a monthly expense of ……… Additionally, I support my elderly mother in my native place, ………., where I am also responsible for home loan EMIs. My wife and mother are entirely dependent on my income, and the continuation of my suspension is severely straining our financial stability. Compounding this, I have been unable to share the news of my suspension with my family due to their delicate emotional well-being, causing me significant mental distress. The very state of being suspended carries a social stigma and has been emotionally taxing.

Therefore, with the utmost humility, I earnestly implore your kind consideration of my circumstances and respectfully request the revocation of my suspension. I assure you of my complete cooperation with any inquiry that may be deemed necessary. For your ready reference, I have enclosed copies of the relevant orders and memos. I sincerely hope for a positive and compassionate response to my appeal.
