238. General examination of charged employee by the Inquiry officer
After recording all evidence, the inquiry officer may put some questions to the charged employee to examine him generally on the circumstances appearing against him in the evidence. In one situation, i.e., where he has not opted to be his own witness, asking of questions is mandatory. The purpose is to enable him to explain any circumstances appearing in evidence against him. These questions are to be answered by charged officer himself.
The general examination by the inquiry officer must remain within the confines of a “general examination' by an impartial officer with a view to securing necessary information to understand the matter. The rules require that such questions may relate to the circumstances appearing against the charged employee in the evidence for the purpose of enabling him to explain the same. The general examination must not take the shape of piercing or searching questions by the inquiry officer. In no circumstances, he can cross-examine the charged employee.
