15. How these safeguards provided in the constitutions are implemented?
The Central Government have evolved the Discipline rules named CCS (CCA) Rules - 1965, through which detailed procedure for initiating conducting and concluding the disciplinary proceedings. Failure to observe these procedures may entail the action null and void. Therefore the strict observance of these rules is made imperative to all concerned.
16. Who is the Disciplinary Authority?
Disciplinary Authority is defined the Rule 2 (g) of CCS (CCA) Rules - as "the authority competent under these rules to impose on a Government Servant among of the penalties specified in Rule - 11. Rule 5, 9, 12 and the Schedule of CCS (CCA) Rules - 1965 give complete details of the appropriate disciplinary authority in respect of all Government servants in all cadres.
17. What is suspension?
Suspension is a temporary deprivation of office. Though it is not a punishment it causes lasting damage to the reputation to the affected official and its stigma is not easily washed away.
18. Who can place a Government Servant under suspension?
The appointing authority or any authority to which it is subordinate or the Disciplinary Authority or any other authority empowered by the President can place a Government Servant under suspension.
