Sir,
I am in receipt of the Charge Sheet issued under Memo No. ASP …………………, issued to me under Rule 10 of the Gramin Dak Sevaks (Conduct & Engagement) Rules, 2011. After thoroughly scrutinizing the content of the Charge Sheet, and reviewing it against the relevant provisions of the GDS (C&E) Rules, 2011, I find the Charge Sheet to be defective in nature.
To elaborate, the issuance of a Charge Sheet under Rule 10 must adhere strictly to the guidelines and instructions set forth by the Directorate General. Specifically, the Director General's instructions, as communicated in D.G. P&T Letter No. 18/3/85-Disc, dated 24th May 1985, clearly stipulate the procedural requirements that must be followed while preparing and issuing such Charge Sheets. Paragraph 2 of this communication, which outlines the instructions under Rule 10 of the GDS (C&E) Rules, 2001, serves as a guiding reference for ensuring compliance.
Upon review, it is evident that the Charge Sheet issued to me fails to comply with these instructions. The deviations from the prescribed procedures render the Charge Sheet invalid and procedurally flawed. The specific instructions, as per the D.G.’s letter mentioned above, were not followed in the preparation of the Charge Sheet, making it legally untenable.
In light of the aforementioned facts, I submit that the Charge Sheet is defective. I respectfully request that the Appointing Authority consider this representation and take immediate action to rectify the situation by cancelling the defective Charge Sheet.
