Deciding Relevance of Defence Documents and Witnesses

230. The Government of India have issued detailed instructions on the subject, vide. Ministry of Home Affairs 0.M. No. 30/5/61-AVD, dated 25.8.1961. These instructions provide that the relevance of a document should be looked at from the viewpoint of defence and if the document is in any way relevant it should be allowed. Further, if the Inquiry officer is not clear about the relevance at the time when the request is made, he should allow it. Thus, a document can be refused in exceptional cases only, for which the Inquiry officer has to record his reasons.

Requisitioning the Additional or Defence Documents 

231. After deciding the question of relevance, the Inquiry officer shall requisition the defence documents he has allowed, from its custodians. The authority to whom the document belong cannot sit in judgment over the decision of the inquiry officer over the question of relevance but may refuse to produce a document on the ground of public interest or security of State. The power can be exercised by the Head of Department in deserving cases.

பாதுகாப்பு ஆவணங்கள் மற்றும் சாட்சிகளின் பொருத்தத்தை தீர்மானித்தல்

230. இந்திய அரசாங்கம் இந்த விஷயத்தில் விரிவான அறிவுறுத்தல்களை வெளியிட்டுள்ளது. உள்துறை அமைச்சகத்தின் O.M. எண். 30/5/61-AVD, தேதி 25.8.1961 ஐப் பார்க்கவும். இந்த அறிவுறுத்தல்கள், ஒரு ஆவணத்தின் பொருத்தப்பாடு பாதுகாப்பின் கண்ணோட்டத்தில் பார்க்கப்பட வேண்டும் என்றும், ஆவணம் எந்த வகையிலாவது தொடர்புடையதாக இருந்தால் அதை அனுமதிக்க வேண்டும் என்றும் வழங்குகின்றன. மேலும், கோரிக்கை வைக்கப்படும் நேரத்தில் விசாரணை அதிகாரிக்கு அதன் பொருத்தம் குறித்துத் தெளிவாகத் தெரியவில்லை என்றால், அவர் அதை அனுமதிக்க வேண்டும். இவ்வாறு, ஒரு ஆவணத்தை விதிவிலக்கான சந்தர்ப்பங்களில் மட்டுமே மறுக்க முடியும், அதற்கு விசாரணை அதிகாரி தனது காரணங்களைப் பதிவு செய்ய வேண்டும்.

கூடுதல் அல்லது பாதுகாப்பு ஆவணங்களைக் கோருதல்

231. பொருத்தப்பாடு என்ற கேள்வியைத் தீர்மானித்த பிறகு, விசாரணை அதிகாரி அவர் அனுமதித்த பாதுகாப்பு ஆவணங்களை அதன் காப்பாளர்களிடமிருந்து கோர வேண்டும். ஆவணம் யாருக்குச் சொந்தமானது என்பது, பொருத்தப்பாடு என்ற கேள்வி குறித்து விசாரணை அதிகாரி எடுத்த முடிவின் மீது தீர்ப்பு வழங்க முடியாது, ஆனால் பொது நலன் அல்லது அரசின் பாதுகாப்பு என்ற காரணத்திற்காக ஆவணத்தை வழங்க மறுக்கலாம். இந்த அதிகாரத்தை தகுதியான சந்தர்ப்பங்களில் துறைத் தலைவர் பயன்படுத்தலாம்.
