79. What are the key provisions and conditions, including the relevant OM Number and date from the Ministry of Finance, for the fixation of pay on promotion to a post carrying higher duties and responsibilities but the same Grade Pay as the feeder post, and how was this decision subsequently communicated and implemented by the Department of Posts?
1. Ministry of Finance, Department of Expenditure O.M. (No. 10/02/2011-E.III/A dated 7th January, 2013)
This Office Memorandum (O.M.) from the Ministry of Finance addresses the method of pay fixation when the promotional post carries the same Grade Pay as the feeder post.
The O.M. refers to Rule 13 of the CCS(RP) Rules, 2008, which governs pay fixation on promotion on or after 1.1.2006, typically involving a move from one Grade Pay to another. Rule 13 provides for pay fixation by adding one increment equal to 3% of the sum of the pay in the pay band and the existing grade pay, then rounding the result to the next multiple of 10.
The President decided that in cases of promotion from one post to another where the promotional post carries the same Grade Pay as the feeder post, the pay fixation will be done in the manner prescribed in Rule 13(i) of the CCS(RP) Rules, 2008.
This benefit is applicable provided that pay fixation in such cases was done prior to 1.1.2006 in terms of the Ministry's earlier O.M. No. 169/2/2000-IC dated 24.11.2000. This earlier O.M. had permitted the benefit of pay fixation under FR 22(I)(a)(1) in similar circumstances when higher responsibilities were involved and restructuring wasn't feasible.
2. Department of Posts (Directorate's Letter No. 01-01/2011-PAP dated 30.04.2014)
The Department of Posts (Establishment Division) forwarded the Ministry of Finance O.M. dated 7th January, 2013, to all Chief Postmasters General and other relevant officers for kind information and further necessary action. The date of the Directorate's forwarding letter is 30.04.2014.
3. Subsequent Communications
Circle Office Letter (No. ESB/135-9/2012 dated 14.05.2015): The Tamil Nadu Circle office, through the Chief Postmaster General, circulated the Directorate's letter (dated 30.04.2014) and the Ministry of Finance O.M. (dated 7th January, 2013) to various offices for information and necessary action.
