Considering Written Statement of Defence

218. It is obligatory for the disciplinary authority to give due consideration to the reply where it has been submitted, by giving personal hearing to the charged employee if he has requested for one. The disciplinary authority should not hesitate to drop the charges if the facts communicated are convincing and no misconduct is made out. However, the Central Vigilance Commission should be consulted, where their advice was obtained earlier.

219. Where all or some of the charges are admitted by the public servant, the disciplinary authority shall record its findings on such charge(s), after taking such evidence as it may deem fit. Where the charges are not admitted or no reply to the charge sheet is filed, the disciplinary authority may proceed to appoint an inquiry officer to hold oral inquiry in accordance with the relevant rules.

218. குற்றஞ்சாட்டப்பட்ட ஊழியர் கோரிக்கை விடுத்திருந்தால், ஒழுங்கு நடவடிக்கை அதிகாரமானது, பெறப்பட்ட பதிலுக்கு உரிய கவனம் செலுத்துவதும், தனிப்பட்ட முறையில் விசாரணை வழங்குவதும் கடமையாகும். தெரிவிக்கப்பட்ட உண்மைகள் நம்பத்தகுந்ததாகவும், தவறான நடத்தை எதுவும் கண்டறியப்படவில்லை என்றும் கண்டறியப்பட்டால், ஒழுங்கு நடவடிக்கை அதிகாரம் குற்றச்சாட்டுகளை கைவிடத் தயங்கக்கூடாது. இருப்பினும், மத்திய ஊழல் கண்காணிப்பு ஆணையத்தின் ஆலோசனை பெறப்பட்டிருந்தால், அவர்களைக் கலந்தாலோசிக்க வேண்டும்.

219. அனைத்து அல்லது சில குற்றச்சாட்டுகளையும் அரசு ஊழியர் ஒப்புக்கொண்டால், ஒழுங்கு நடவடிக்கை அதிகாரம் பொருத்தமானதாகக் கருதும் சான்றுகளைப் பெற்ற பிறகு, அத்தகைய குற்றச்சாட்டு(களில்) தனது கண்டுபிடிப்புகளைப் பதிவு செய்ய வேண்டும். குற்றச்சாட்டுகள் ஒப்புக்கொள்ளப்படவில்லை என்றாலோ அல்லது குற்றச்சாட்டுப் பத்திரத்திற்கு பதில் அளிக்கப்படவில்லை என்றாலோ, ஒழுங்கு நடவடிக்கை அதிகாரம் தொடர்புடைய விதிகளின்படி வாய்மொழி விசாரணை நடத்த விசாரணை அதிகாரியை நியமிக்கலாம்.
