6 Whether Dies non, EXOL without MC etc will cause the postponement of increment which was in existence earlier?

After the R. P. Rules 2008, the date of increment will be 1st July every year for all employees. After Seventh pay commission the annual increment will be either on 1st January or 1st July every year. If an employee has completed six months or more after his last increment in January or July, he is

entitled for next annual increment. As such there is no effect on the grant of annual increment for the period of Dies non, EXOL without MC etc up to six months in one year starting from January to June or July to June next year respectively.

7. Whether the senior joins the higher post later than his junior and draws lesser pay can claim stepping up of pay with his junior?

If a senior joins the higher post later than the junior for whatsoever reasons whereby he draws less pay than the junior in such cases, senior cannot claim stepping up of pay at par with the junior vide Para 2 (c) of GIO (27) under FR 22 in “Swamy’s Compilation of FR & SR, Part-I-General Rules”.

8. How option can be made for pay fixation on the date of promotion which will be advantageous?

As per the existing pay rules, if the promotion is in between 2nd July to 31st December, his next increment will be from 1st July of the same year. If the promotion is accorded in between 1st Jan to 30th June in a year and opted for direct fixation, his increment will be drawn only in the next year. So, one has to carefully study before making an option for pay fixation at the time of promotion.

9. Whether the facility of availability of exercising option shall be intimated to the officials on promotion in the orders?

Yes. As per DP & AR OM No. F13/26/82-Estt PI. dated 08.02.1983 & DOPT OM No. 13/2/2007-Pay I dated 10.08.2007, the promotion order should contain the availability of option available to the promoted official.

10. Whether the provision of option under FR 22 (I) (a) (1) is admissible in respect of adhoc promotion?

As per the provisions of FR 22 (I) (a) (1) option is not admissible in respect of ad hoc promotions. If such promotion is followed by regular appointment to the higher post without any break, option may be allowed as from the date of initial appointment.

    1. EXOL without MC will not be counted for increment. Because now six months is sufficient the EXOL will not affect the increment
