81. What amendment to the Fundamental Rules, 1922, was implemented by the Fundamental (Eighth Amendment) Rules, 1963, as circulated by P&T Order No. 48/6/63-SPB II dated 23rd Nov, 1963, and what are the resulting conditions under the amended FR 26(b)(i) for Extra-ordinary Leave (EOL) to count as service for the purpose of granting increments, particularly for temporary or officiating Government servants?

The P&T order, No. 48/6/63-SPB II dated 23rd Nov, 1963 , circulated the Fundamental (Eighth Amendment) Rules, 1963 , which were introduced by the Ministry of Finance (Department of Expenditure) O.M. dated 22nd October, 1963 , to amend the Fundamental Rules, 1922. The key change was the substitution of the phrase in Rule 26(b)(i) to specify that "Leave except extraordinary leave taken otherwise than on medical certificate" shall be counted for increments. This amendment meant that Extra-ordinary Leave (EOL) taken on account of illness and covered by proper medical certificates will count for increments for both permanent and temporary/officiating Government servants. For temporary/officiating Government servants, however, the EOL period counts for increment only to the extent covered by a required certificate confirming that the employee would have continued to officiate in that post but for their proceeding on EOL.
