381. Commencement of 45 days for appeal is from the date of communication
The time-limit of forty-five days prescribed for submission of an appeal will count from the date on which the reasons for suspension are communicated.

382. Controversial provisions
As per sub-rule (5) (a) of Rule 10 of CCS (CCA) Rules, an order of suspension made or deemed to have been made continues to me in force until it is modified or revoked by the authority competent to do so. As per sub-rule (7) ibid., an order of suspension shall not be valid after a period of 90 days unless it is extended after review, further period before the expiry of 90 days.
383. Revocation of suspension is automatic in case of deemed suspension
In case of deemed suspension, when the cause of suspension ceases to exist, the revocation of suspension is automatic and orders may be issued. DOP OM No. 35014/9/76-Estt. St. 08.08.1977.
384. Period of suspension will be treated as duty if not regularized before retirement
If the period of suspension is not regularized after reinstatement, it will count as duty only for the purpose of pension.

385. The suspension, regulation of subsistence allowance and the treatment of period of suspension are appealable.
