1000 TIT BITS ON DISCIPLINE -89'
306. Death during suspension
The family shall be entitled to all benefits as if the employee was not placed under suspension at all. The family pension in full shall automatically follow. In this view of the rules [F. R. 54-B(2)] no formal order treating the period of suspension as duty shall be necessary. (The insistence for a formal order in terms of Note 3 below Rule 33 of the Pension Rules shall only be a wooden formality, causing avoidable harassment to the bereaved family).
307. Cases of Exoneration
Full pay and allowances is the normal rule. In exceptional cases, suitable reduction can be made if the proceedings were delayed for the reasons directly attributable to the employee. But, even in such a case, a show cause notice returnable within sixty days is necessary. The period of suspension shall, however, be treated as duty for all purposes [FR. 54-B(3)].
308. Where only a minor penalty is imposed
The Government of India have decided that in such cases the suspension should be treated as wholly unjustified and full pay and allowances shall be paid
[DOP&T O.M. No. 11012715/85- Estt.(A), dated 3rd December, 1985).
309. Where a major penalty is imposed
No further orders under F.R. 54-B are necessary in case of removal or dismissal from service. In other cases, full pay and allowances shall not be granted but no recovery can also be made from the subsistence allowance already paid. Actual amount is determined by the Appointing authority after a show cause notice to the employee which is returnable within sixty days. The Appointing authority also decides whether the period shall count as duty for various purposes, such as increment, leave, pension etc., and if so to what extent [F.R. 54-B(5)].
